Summer Abuses
Armed troops occupy Washington, D.C., Los Angeles, Portland, and Chicago. They are there to protect ICE agents and property from damage by persons objecting to inhumane, illegal, unconstitutional, and unsustainable ICE operations conducted by masked and armored agents using military equipment to raid without warrant and arrest based on ethnic appearance or employment. By executive order, social platform pronouncements, and random rantings, the Tyrant Trump has labeled anyone standing against his implementation of the Project 2025 playbook as an enemy of fascism and, therefore, subject to arrest, detainment, and punishment.
Trump 2.0 is losing public favor. The Mad King does not intend to release his grip on power. Now. Or ever. He is concerned about the possibility that Election 2026 will expose him to punishment for those of his actions not protected by the immunity granted him in 2024 by the partisan Roberts Court in Trump v. United States.
Gerrymandering and voter suppression opportunities have his attention and support.
Fall Follies.
1. Congress. The Speaker of the House very quickly sent representatives home and refused to swear in the most recently and fairly elected candidate for public service. He suspended Article One operations to avoid bringing the demand for open and unredacted Epstein filles to a floor vote.
2. The Supreme Court returned to the bench to consider a low visibility merit pleading against the right of the United States Postal Service (USPS) to refuse service purposefully and selectively.
Overview of the Issue
1. A black lady with white tenants set up a system for receiving and forwarding their mail;
2. After some time and without forward notice, the USPS exercised its power to refuse to continue to provide service to her;
3. She complained in person and then in law that she was losing rental income and was the victim of racial discrimination;
4. The district court denied both of her claims;
5. The appeals court also refused to support her claim of racial discrimination but allowed the possibility that the USPS was responsible for intentionally failing its stated purpose and duty;
6. The USPS appealed to the Supreme Court to support its power to purposefully and selectively refuse service.
7. A ruling by the high Court in favor of the USPS will allow, if not invite, an Executive Order directing the USPS to refuse to process mail-in ballots in forthcoming elections.
Details of the Case
The crux of the issue is whether the immunity Congress gave the USPS for mail delivery problems covers mere mistakes or also acts alleged to be intentional. Current federal law (Federal Tort Claims Act) protects the USPS from claims “arising out of the loss, miscarriage, or negligent transmission of letters or postal matter.”
1. The pleading is brought by Lebene Konan:
a. She owned two pieces of real estate in Euless, Texas;
b. She rented space in each of these properties to tenants;
c. Lebene rented a box from USPS for each property;
d. She directed the USPS to deliver business and tenant mail related to each rental property to the appropriate box;
e. In May of 2020, USPS employee Jason Rojas changed the lock on the mailbox at one of her properties without her approval, halted mail delivery, and demanded ownership verification;
f. Even after USPS’s Inspector General confirmed her ownership, Rojas and another employee, Raymond Drake, allegedly continued marking mail addressed to her and her tenants as undeliverable;
g. She claims this refusal of service extended to her second property;
h. She lost rental income; and,
i. Essential personal and business communications were disrupted.
2. Lebene wears black skin. The surnames of Rojas and Drake suggest different ethnic backgrounds.
3. Lebene claimed racial discrimination and asked for consideration and relief under the Federal Tort Claims Act (FTCA), alleging violations of the equal protection guarantees of 42. U.S.C. 1981 and 1985.
a. The district court dismissed her FTCA claim for lack of subject matter jurisdiction (under the postal-matter exception), and her equal protection claims for failure to state a claim; but,
b. The Fifth Circuit affirmed the dismissal of equal protection claims but reversed on the FTCA claim, hold that sovereign immunity did not bar her claims based on intentional acts of mail non-delivery.
4. The Supreme Court accepted the case on its merit and heard arguments on the issue in its first session of 2025.
a. The issue was considered as: Does a claim that Postal Service employees intentionally refused to deliver mail to a designated address arise out of “the loss” or “miscarriage” of postal matter under the Federal Tort Claims Act’s postal-matter exception?
5. From the bench on 08 Oct 25, the partisan justices seemed more concerned with the number of suits that would arise if USPS was required to answer for its impropriety than about the validity of, and remedy for, the instant issue of harassment. It speaks volumes that the government refused to acknowledge local error and offer appropriate settlement.
a. The shades of the Catholic Church titter in the peanut gallery. Abuse by power need not be sexual to be long-standing, improperly protected, damaging, and unacceptable. And dangerous.
b. Judicial watchdogs have warned that a ruling in support of USPS would allow, if not invite, the possible misuse of the Service for voter suppression in its discretionary (or directed denial of service) handling of mail-in ballots in forthcoming elections.
This case is possibly just another very consequential decision. Right up there with 2010 Citizens United v FEC (unrestricted campaign financing) and 2024 Trump v. United States (absolute immunity from criminal prosecution for actions within his conclusive and preclusive duties as a president).
Meditation
As of 14 Oct 25, the Tyrant Trump is basking in recognition for his part in causing a cease-fire in the 2-year-old conflict between Israel and Hamas.
The exchange of hostages was 20 live citizens of Israel for 2000 persons captured and held by Israel during hostilities. These are welcome and overdue actions. They stink of the burnishing of the brand and further corrupt enrichment of net worth of the sitting president, his family, and his loyalists. They are worthy of further comment in a separate posting.
For the moment, let us remember and understand the Mad King is on a roll. He barely can navigate a set of steps. His attempts at public speaking are increasingly incoherent. Still he persists. The habits of a lifetime continue. He is addicted to taking protected risks. He cons Other People into to allowing him to gamble with their money. He gets a share of what he wins. The marks take any loss entire. In 1978 Bob Seger captured the essence of the Transactional Tyrant and this moment with the following lyrics. The tune is rocking.

Manifesto
We the People unhappy with the results and consequences of Election 2024 do not agree to be the “mark” of the Transactional Tyrant.
It is time to Dump Trump.
1. Project 2025 does not need him.
a. His usefulness is diminishing.
b. Implementation of the horrific Project 2025 playbook will continue until halted and corrected. With or without him as the face of its assault on the plain face reading and meaning of the Declaration of Independence, the Constitution, the Bill of Rights, all amendments, custom, and the law of the land on 20 Jan 25.
Losing the Trump Show only will return a certain amount of corruption to the private sector. And relieve We the People of the obligation to finance it. Why agree to allow him to continue to attempt to bankrupt our nation for his personal fun and profit?
A generation of senior citizens is standing on bridges, on sidewalks, and in streets, holding signs and peacefully refusing to surrender to Trump 2.0 the human and constitutional rights hard won over the last 70 years. Younger persons in animal costumes are challenging armed and masked agents of the immoral, inhumane, unconstitutional, and unsustainable ICE operations to relent and retreat. Throwing a submarine sandwich at a rogue ICE agent is a celebrated act of resistance. Naked cyclists in Portland are the opposition heroes of their generation.
Anthem
There is no case for plausible deniabilty in the actions of the Roberts court. It is corrupt. Its rulings are a betrayal of trust, a derilection of duty, and a breach of contract with terms of service to the governed. It is a disgrace begging for remedial action.
Winning Elections 2026 and 2028 can serve as a first step to obtaining a Senate which will accept and evaluate candidates for the high bench without fear or favor.
To that end, and in support of the necessary repair of damage wrought by implementation of the 2025 playbook to the principles, practices, and operation of Pax Americana, let us understand and accept:
The fact, intent, occurance, and results of Election 2026 require determined and sustained protection. The right to vote, the fair and full counting of ballots cast, and the peaceful transfer of power are at risk.
Our Dear Leader refuses to lose. Let us do likewise.
There is no room for despair or time for delay. Let us each continue to exercise our indivisible Power of One. Let us continue to use our persons and our purses every day everywhere in every legal way to deny, delay, disassemble, defeat, and destroy Trump 2.0.
Election 2026 is critical. Let us covenant with each other to remember ourselves well as we refuse to be discouraged or side tracked. Let us keep the pressure on DEI deniers and the breakers of private, public, and constitutional oaths. Let us demand respect for our presence and our power. Let us require faithless representatives to repent, reform, or retire.
Let us be innovative, strategic, loud, and persistent.

Trump is doing to the American people what he bragged about doing to women.
Trump sees himself as the brightest star in the firmament: “ I run the country and the world.”
Knowing that he can freely do it to women, as he was recorded bragging on the “Access Hollywood” tape, he knows that he can do it to all the American people:
“ It’s like a magnet…I don’t even wait. When you’re a star, they’ll let you do it. You can do anything. Grab them by the p----. You can do anything.”
And that’s exactly what he’s doing to us. We are all his victims.
